Welcome to PTEsolution90 (“PTEsolution90”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your use of www.ptesolution90.com and any related products or services we provide, including live and recorded online classes, onsite (face-to-face) training, mock tests, downloadable materials, one-to-one coaching, subscriptions, and other educational services (collectively, the “Services”). By accessing or using our website or Services you accept and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Definitions

  • “User”, “you”, “your” — any person who accesses or uses the Services.
  • “Account” — a registered user account on our site.
  • “Materials” — course content, study guides, videos, tests, worksheets, templates and other digital or printed resources provided by us.
  • “Third-party Test Provider” — external entities whose tests or policies we reference (for example, Pearson PTE and British Council). See Section 11.

2. Eligibility

  • You must be at least 16 years old to register for general Services. For certain Services (for example, advanced courses or certification), you may need to be 18+. If you are under 18 you must obtain consent from a parent or legal guardian and they must accept these Terms on your behalf.
  • By creating an Account and/or purchasing Services you warrant that you meet any eligibility requirements and that the information you provide is accurate and up to date.

3. How a Contract is Formed

  • Orders for paid Services are subject to our acceptance. A legally binding contract between you and PTEsolution90 is formed when we accept your order and send a confirmation (for example by email or an Account notification).
  • We may decline or cancel any registration, order or enrolment at our discretion (for example, where we suspect fraud, unauthorised use, or non-compliance with these Terms).

4. Our Services

  • We provide preparatory training and related Services to help candidates prepare for English language tests such as the PTE Academic. We are not the test provider and do not administer Pearson PTE or British Council tests. References to those third parties are for convenience and guidance only (see Section 11).
  • Course delivery modes: online (live or recorded), onsite (face-to-face), or hybrid. Each course listing will specify the delivery mode, schedule, inclusions, and any technical requirements. You agree to follow the stated requirements and join sessions on time.

5. Account Registration & Security

  • To access certain Services you must create an Account. You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. Notify us immediately if you suspect unauthorised use.
  • We may suspend or terminate Accounts where we reasonably suspect misuse, fraud, or breach of these Terms.

6. Fees, Payments & Subscriptions

  • All fees are displayed in AUD (unless otherwise stated). You must pay the fees shown at the time you enrol. Fees include applicable taxes unless otherwise stated.
  • Payment methods: We accept the methods shown at checkout (e.g., credit/debit cards, PayPal, bank transfer). For onsite payments we may accept alternative methods.
  • Subscriptions & auto-renewals: If you purchase a subscription plan, your subscription will auto-renew at the end of the billing period unless you cancel before renewal. You authorise us to charge the payment method on file for renewal fees.
  • Failed payments: If a payment fails, we may suspend access to paid Services until you resolve the balance.

7. Cancellations, Rescheduling & Refunds

We aim to be fair and transparent. Our refund and cancellation approach is set out below and in more detail in our Refund Policy (link).

7.1 Your cancellations / rescheduling

  • Live courses & workshops: If you cancel or request rescheduling at least 14 days before the start date, you may receive a full refund minus any non-refundable administration fees. Cancelling between 7–14 days may be eligible for a 50% refund. Cancellations under 7 days before start may not be refundable.
  • Subscription plans: Cancel anytime via your Account to prevent future auto-renewal. No refunds are provided for the remainder of the billing period except where required by law.
  • One-to-one tutoring: Cancellations require 48 hours’ notice. Failure to provide sufficient notice may result in a charge for the session.
  • We may make exceptions at our discretion (for example, illness or emergency) and may require supporting documentation.

7.2 Our cancellations / rescheduling

  • If we cancel a class or Service, we will offer you an alternative session or a full refund for the affected Service. Where we must reschedule due to circumstances beyond our control we will use reasonable efforts to find a suitable alternative.
  • We are not liable for indirect losses or for events outside our reasonable control (force majeure). See Section 18.

7.3 Consumer rights

  • Nothing in these Terms limits your statutory rights under the Australian Consumer Law (ACL). If a Service fails to meet a consumer guarantee under the ACL you may be entitled to a remedy (including refund, replacement or compensation). Our refund policy does not exclude rights you cannot lawfully contract out of.

8. Third-Party Providers & External Links

  • We may link to or reference third-party providers (for example, Pearson PTE at https://www.pearsonpte.com and British Council at https://www.britishcouncil.org). These organisations are independent and have their own terms and policies. You must comply with any terms required by such third parties.
  • We are not responsible for the content, policies, practices, or availability of third-party websites, services or products. Where you use third-party services (including booking an official test), you do so subject to that provider’s terms.

9. Intellectual Property

  • All content on our website and Materials are owned by us or our licensors and are protected by copyright, trademark and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use Materials for personal, non-commercial educational use only.
  • You must not copy, reproduce, distribute, publish, adapt or create derivative works from our Materials except as expressly permitted. Any unauthorised use may result in termination of access and potential legal action.
  • Course questions, mock test content and other assessment items are provided for study only and must not be published or shared.

10. User Content & Conduct

  • User content: Where you submit content (for example, assignments, forum posts or feedback) you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify and publish such content solely to provide the Services, improve our offerings, and for promotional purposes (unless you tell us otherwise). Do not submit personal or confidential information as user content.
  • Prohibited conduct: You must not use the Services to harass, defame, infringe third-party rights, upload malicious code, attempt to gain unauthorised access, or conduct illegal activities. We may remove content or suspend Accounts for breaches.

11. Recording & Use of Live Classes

  • Live classes and webinars may be recorded for educational, quality assurance and training purposes. Unless specified otherwise, recordings are our intellectual property and are made available to enrolled students only. You must not record, reproduce or distribute live sessions without our prior written consent.

12. Privacy & Data Protection

  • Our Privacy Policy explains how we collect, use, store and disclose personal information. By using the Services you consent to the collection and processing of your information as described in the Privacy Policy.
  • We will only share personal data with third parties (payment processors, hosting providers, analytics providers) as necessary to provide the Services and in accordance with our Privacy Policy. Where required by law, we will comply with user requests to access, correct or delete personal data.

13. Cookies & Tracking Technologies

  • We use cookies and similar technologies to provide functionality, personalise content and analyse site usage. For more information, see our Cookies Policy. You can control or delete cookies through your browser settings, but disabling cookies may affect site functionality.

14. Warranties & Disclaimers

  • No guarantee of results: While we provide study materials, instruction and practice to help you prepare for tests, we cannot guarantee any particular score, outcome, admission or migration result. Any claims about outcomes are illustrative and based on past student experience; individual results vary.
  • No professional advice: The Services do not constitute legal, immigration or other professional advice. For such matters seek independent professional advice.

15. Limitation of Liability

  • To the fullest extent permitted by law, our liability for loss or damage arising from or in connection with these Terms or the Services is limited to the amount you paid for the specific Service in the 12 months preceding the claim.
  • We are not liable for indirect, special or consequential losses (including loss of profits, loss of data or loss of goodwill) except where such exclusion is not permitted by law. In jurisdictions where consumer guarantees apply, certain liability limits may not apply.

16. Indemnity

You indemnify and keep us indemnified from and against any claims, losses, liabilities, damages, costs and expenses (including legal fees) arising out of your breach of these Terms, your negligence, or your infringement of any third-party rights.

17. Suspension & Termination

  • We may suspend, restrict or terminate your access to all or part of the Services if you breach these Terms, where we reasonably suspect fraud, unlawful activity or unauthorised use.
  • On termination, your Account access will be disabled. Termination does not affect any rights or obligations that accrued prior to termination (for example fees owed or IP breaches).

18. Force Majeure

We are not liable for failure or delay in performing obligations to the extent caused by events beyond our reasonable control (for example, natural disasters, pandemic restrictions, government actions, strikes, internet outages). In such cases we will use reasonable efforts to resume Services or offer alternatives.

19. Complaints & Dispute Resolution

  • If you have a complaint, please contact us at the address below. We will acknowledge receipt and attempt to resolve the matter promptly.
  • If we cannot resolve a dispute informally, either party may seek mediation or bring proceedings in the courts of Victoria, Australia, as set out below.

20. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria, Australia, subject to any non-excludable rights under law.

21. Changes to These Terms

We may update these Terms from time to time. Where changes are material we will use reasonable efforts to notify you (for example by email or site notice). Continued use after notification constitutes acceptance of the updated Terms.

22. Other Important Terms

  • Assignment: We may assign our rights under these Terms to a third party. You may not assign your rights without our consent.
  • Severability: If any provision is found invalid or unenforceable, the remainder of these Terms will continue in force.
  • Entire Agreement: These Terms (and any documents they incorporate by reference such as the Privacy Policy and Refund Policy) form the whole agreement between you and PTEsolution90 in relation to the Services.

We aim to make our Services accessible. If you require reasonable adjustments due to disability or other needs, please contact us and we will make reasonable efforts to accommodate you.
